Seasonal Rental Contract for Direct Bookings

Article 1: Preamble and Scope

These General Terms and Conditions of Sale (CGV) apply by right, without restriction or reservation, to all short-term accommodation bookings made directly by the Customer (hereinafter referred to as "the Tenant" or "the Customer") on the Owners' website (hereinafter referred to as "the Lessors"), via the reservation widget of the centralized management tool Nowistay.

These CGV govern the rental of the following two holiday accommodations:

  • The accommodation located on Reunion Island (France).
  • The accommodation located in Albufeira, Algarve (Portugal).

The validation of the reservation by the Customer implies the express, full and unreserved acceptance of these CGV. The Customer acknowledges having read these CGV prior to booking and having the legal capacity to contract.

Article 2: Booking Process and Contract Conclusion

Booking is done directly online via the secure widget provided by the Nowistay tool integrated into the Lessors' site.

The contractual process includes the following steps:

  • Selection of stay dates, the relevant accommodation, and the number of travelers by the Customer.
  • Display of the total price of the stay, including the mandatory cleaning fee and, if applicable, local taxes.
  • Entry of the Customer's personal details.
  • Mandatory acceptance of these CGV by checking the dedicated box provided for this purpose.
  • Full and immediate payment of the stay by credit card or any other authorized payment method via the secure payment platform Stripe.

The reservation becomes final and the seasonal rental contract is deemed concluded upon validation of payment by Stripe and the sending of an automatic confirmation e-mail to the Customer summarizing the details of their stay.

Article 3: Price, Local Taxes and Payment Methods

Prices are indicated in Euros (€) and include all taxes (TTC), excluding cleaning fees or specific taxes explicitly mentioned at the time of payment.

3.1. Cleaning Fees

The cleaning fee is mandatory and is added on top of the nightly price. Its exact amount is clearly displayed on the Nowistay widget before final validation of the order.

3.2. Payment Methods

In accordance with the commercial policy chosen by the Lessors, a deposit corresponding to 100% of the total amount of the stay is required immediately upon booking. Payment is made exclusively by credit card or any other secure payment method offered through the payment operator Stripe. No other payment method (cheque, cash) is accepted for the reservation.

3.3. Differentiated Tourist Tax Regime

Due to the distinct geographical location of the properties, the collection of the tourist tax is subject to two specific tax legislations:

Accommodation in Reunion Island (France)

Inclusion and direct payment: The tourist tax is directly calculated, displayed, and integrated into the total amount paid online by the Customer during the reservation on the Nowistay widget.

Regulatory calculation method:

The calculation is based on the legal formula in force for unclassified furnished accommodations:

Tax = (Nightly rate / Number of occupants) × 5.00% per night and per taxable occupant.

Indicative example: For a 5-night stay for 2 people at 100 € per night:

  • Nightly rate per occupant: 50.00 €
  • 5.00% of 50.00 € = 2.50 € per night/person
  • Amount collected: 2.50 € × 5 nights × 2 people = 25.00 €.

Accommodation in Albufeira (Portugal)

Separate payment: The Albufeira municipal tourist tax is not included in the initial booking amount. Its payment must be made separately via a secure Stripe payment link sent later by the Lessors.

Applicable regulatory rates (capped at 7 consecutive nights per stay):

  • High season (April to October): 2.00 € per day and per traveler.
  • Low season (November to March): 1.00 € per day and per traveler.
  • Exemption: Children under 13 are completely exempt.

Article 4: Modification and Cancellation Conditions

Any request for cancellation or modification of a stay must be notified in writing (e-mail) to the Lessors as soon as possible. The applicable refund conditions are strictly defined according to the following time scale:

  • Cancellation made more than 20 days before the scheduled arrival date: Refund up to 100% of the amounts paid.
  • Cancellation made between the 20th and the 10th day inclusive before the scheduled arrival date: Refund up to 50% of the amounts paid. The remaining 50% is kept by the Lessors as contractual cancellation compensation.
  • Cancellation made less than 10 days before the scheduled arrival date: No refund will be granted. The entire amount of the stay remains acquired by the Lessors.

No-show: If the Customer does not show up at the accommodation on the scheduled day of arrival without prior written notification accepted by the Lessors, the reservation will be fully canceled by right. No refund will be granted, and the Lessors will freely dispose of the accommodation.

Article 5: Security Deposit

A security deposit is strictly required to cover any damages, material degradation, or serious breaches noted in the accommodation during the stay.

  • Amount for the accommodation in Reunion Island: 300.00 €
  • Amount for the accommodation in Albufeira: 450.00 €

Payment methods: The security deposit is made exclusively in the form of a pre-authorization or bank imprint via a secure link provided jointly by Nowistay and Stripe. No deposit payment by cash or cheque will be accepted.

Restitution: Following the exit inventory and in the absence of degradation, loss of equipment, or exceptional cleaning costs, the bank imprint is automatically lifted or canceled within a maximum of 2 days (48 hours) after the Tenant's departure.

Article 6: Occupation Conditions and Digital Welcome Guide

Practical details regarding arrival and departure times (Check-in / Check-out), the method of access to the accommodation (key handover or self-check-in), specific cleanliness restitution instructions, as well as house rules and strict prohibitions, are not detailed within these CGV.

IMPORTANT: All these house rules, safety instructions, and neighborhood charters are contained in a dedicated document named the Digital Welcome Guide. This guide is automatically sent to the Customer by e-mail 48 hours before their scheduled arrival. The Customer formally commits to reading and strictly respecting its clauses, just like these CGV.

It is reminded that the Customer is required to keep the accommodation in a normal and respectful state of cleanliness, as specified in the guide, under penalty of financial deduction from the security deposit for extraordinary cleaning costs.

Article 7: Responsibility and Insurance

The Tenant is responsible for all damages occurring as a result of their actions or those of the persons accompanying them in the accommodation during their stay. They are invited to verify that they benefit, through their personal home insurance, from a civil liability clause covering damages caused in a holiday accommodation.

The Lessors cannot be held responsible in the event of theft, loss, or deterioration of travelers' personal belongings within the rental, nor in the event of malfunctions of telecommunications networks (Wi-Fi), water, or electricity supplies beyond their control.

Article 8: Applicable Law and Competent Jurisdiction

For direct bookings made with individuals under the LMNP status, the applicable law and competent jurisdictions in the event of a dispute differ imperatively according to the accommodation booked:

  • For disputes relating to the accommodation located in Reunion Island (France): These contractual relations are exclusively subject to French law. Any dispute that cannot find an amicable resolution will be brought before the competent courts within the jurisdiction where the property is located.
  • For disputes relating to the accommodation located in Albufeira (Portugal): These contractual relations are exclusively subject to Portuguese law. Any dispute will be brought before the competent courts of the Portuguese judicial order for the Algarve region (Tribunal de Comarca de Faro).
